1. Acceptance of Terms

By accessing or using CortexGXP ("the Service"), including the website at cortexgxp.com and the Telegram bot @CortexGXPBot, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

These Terms constitute a legally binding agreement between you and CortexGXP, governed by the laws of the Commonwealth of Virginia, United States of America.

2. Description of Service

CortexGXP is an AI-powered trading signal platform that delivers technical analysis signals across Stocks, Cryptocurrency, and Forex markets via Telegram. The Service uses Smart Money Concepts (SMC) analysis and Google Gemini AI to generate and score trading signals.

The Service includes:

Free trading signal alerts delivered via Telegram
AI-powered signal scoring and analysis
Premium features including managed execution and copy trading (paid tiers)
News analysis and market commentary

3. Not Financial Advice

All content provided by CortexGXP, including trading signals, AI analysis, news summaries, and market commentary, is for informational and educational purposes only. CortexGXP is not a registered investment advisor, broker-dealer, or financial planner.

You acknowledge and agree that:

Trading signals do not guarantee profitable trades
Past signal performance does not guarantee future results
All trading involves substantial risk of loss
You are solely responsible for your own trading decisions
You should consult a qualified financial advisor before making investment decisions
You should only trade with capital you can afford to lose

4. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

The Service is not available to residents of jurisdictions where the provision of such services is prohibited by law. You are responsible for ensuring that your use of the Service complies with all applicable laws in your jurisdiction.

5. Account Registration

To use the Service, you must register an account via the Telegram bot @CortexGXPBot or the website registration form. You agree to:

Provide accurate and complete information during registration
Maintain the security of your Telegram account
Notify us immediately of any unauthorized use of your account
Not share your account with any third party
Maintain only one account per person

6. Subscription Plans and Payments

CortexGXP offers the following service tiers:

Free: Signal alerts via Telegram, available forever at no cost
Basic ($5/month): Signals plus managed execution features
Pro ($10/month): Signals plus automated copy trading

A 30-day free trial of premium features is available upon registration. After the trial period, continued access to premium features requires a paid subscription. Payments are processed securely via Stripe. Subscriptions automatically renew unless cancelled. You may cancel your subscription at any time through the Telegram bot or by contacting support.

7. Broker API Keys and Managed Execution

Premium subscribers may optionally connect their broker accounts (Alpaca, OANDA) to enable managed execution or copy trading features. By connecting your broker account, you:

Authorize CortexGXP to place trades on your behalf according to your selected plan
Acknowledge that automated trading carries additional risks
Accept full responsibility for all trades executed in your account
Understand that CortexGXP is not liable for any losses resulting from automated execution

Your API keys are stored encrypted and are never shared with third parties. You may revoke access at any time.

8. Prohibited Uses

You agree not to:

Use the Service for any unlawful purpose or in violation of any regulations
Redistribute, resell, or share CortexGXP signals without written permission
Attempt to reverse engineer, scrape, or copy the Service
Use the Service to manipulate markets or engage in fraudulent trading activity
Create multiple accounts to circumvent subscription requirements
Harass, abuse, or harm other users or CortexGXP staff

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. CORTEXGXP DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. CORTEXGXP DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY SIGNALS OR CONTENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CORTEXGXP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR TRADING LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

CortexGXP's total liability to you for any claims arising under these Terms shall not exceed the total amount paid by you to CortexGXP in the three months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless CortexGXP and its operators from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Modifications to Terms

CortexGXP reserves the right to modify these Terms at any time. We will notify registered users of material changes via Telegram or email. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

13. Termination

CortexGXP reserves the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Virginia, United States of America, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in Fairfax County, Virginia, except that either party may seek injunctive relief in court for intellectual property violations.
